These Terms of Service ("Terms") govern your use of our services, including photography sessions, videography, and any other related services provided by Kevin Lian Photography ("Company," "we," "us," or "our"). By booking our services or purchasing our products, you agree to comply with and be bound by these Terms. Please read them carefully.

1. Services Provided

1.1 Photography and Videography Services
We offer a variety of photography and videography services, including but not limited to event photography, portrait sessions, commercial photography, and video production.

1.2 Booking and Scheduling
To book a session, a non-refundable deposit may be required. All bookings are subject to availability, and we reserve the right to refuse service at our discretion.

1.3 Delivery of Services
Final images and videos will be delivered digitally unless otherwise agreed upon in writing. Delivery times may vary based on the scope of the project and will be communicated to you during the booking process.

2. Payments and Fees

2.1 Pricing
Our pricing for services is provided upon request and may vary depending on the nature of the project, location, and other factors. All prices are subject to change without notice but will not affect confirmed bookings.

2.2 Payment Terms
Payments are due as specified in the invoice provided. Failure to pay may result in cancellation of the service. Payment methods accepted include [list payment methods, e.g., credit card, PayPal, bank transfer].

2.3 Late Fees
Late payments may incur additional fees as outlined in the invoice or contract.

3. Cancellations and Rescheduling

3.1 Client Cancellations
If you need to cancel or reschedule your session, please notify us as soon as possible. Cancellations made within 2 days of the scheduled session may forfeit the deposit. Rescheduling is subject to availability.

3.2 Company Cancellations
In the event we need to cancel a session due to unforeseen circumstances, we will offer to reschedule at a mutually convenient time or provide a full refund of any payments made.

4. Copyright and Usage Rights

4.1 Ownership of Images
All photographs, videos, and related media captured by Kevin Lian Photography remain the property of the Company. We retain the copyright to all images and videos unless otherwise agreed in writing.

4.2 Client Usage Rights
Clients are granted a limited license to use the images and videos for personal or commercial purposes as agreed upon during the booking. This license does not include the right to sell, license, or distribute the images or videos to third parties without our written consent.

4.3 Company Usage Rights
We reserve the right to use images and videos for promotional purposes, including but not limited to portfolio display, social media, and marketing materials. If you wish to opt-out of this, please inform us in writing prior to your session.

5. Liability

5.1 Limitation of Liability
Kevin Lian Photography is not liable for any indirect, incidental, or consequential damages arising out of the use of our services. Our total liability for any claim arising out of or relating to these Terms or our services shall not exceed the amount paid by you for the specific service in question.

5.2 Force Majeure
We are not liable for any failure to perform our services due to events beyond our control, including but not limited to natural disasters, strikes, or acts of God.

6. Privacy and Data Protection

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Ocean, NJ.

We reserve the right to update or modify these Terms at any time. Any changes will be posted on our website, and your continued use of our services after such changes have been posted constitutes your acceptance of the new Terms.
